By carrying out video surveillance in the office of DATEKS.LV, personal data are processed for the purposes of the legitimate interests of DATEKS.LV (Article 6(1)(f) GDPR), i.e. for the prevention and detection of criminal offences in connection with the protection of DATEKS.LV property.
In cases where DATEKS.LV is required to process personal data by law or contract, or as a precondition for entering into a contract, DATEKS.LV cannot ensure the sale of goods and provision of services without processing all necessary personal data.
Who are the recipients of the personal data?
- State and local authorities in cases where DATEKS.LV provides the requested information in compliance with the legal requirements of these authorities;
- courts and law enforcement authorities, when DATEKS.LV provides personal data for the protection of its own or third parties' interests, prevention and detection of criminal offences;
- legal assistance providers when such assistance is required by DATEKS.LV;
- auditors and auditors when carrying out financial and accounting audits and/or audits of DATEKS.LV;
- postal and courier service providers for the delivery and return of goods ordered by the Customer;
- credit institutions for the administration of payments;
- manufacturer's authorised repairers for warranty repairs or other repair and maintenance work on devices for which only an authorised repairer is entitled to carry out such work;
- the leasing company chosen by the Customer in the event that the Customer wishes to purchase goods by engaging a leasing service to provide details of the goods ordered by the Customer;
- thetelecommunications service provider for the purpose of informing the Customer about the performance of the service;

- personal data may also be provided to other DATEKS.LV cooperation partners if it is necessary for the performance of specific functions or tasks and if these partners provide DATEKS.LV with appropriate guarantees in relation to the processing and protection of personal data.
- DATEKS.LV shall store personal data for as long as DATEKS.LV has a legal basis to store personal data:
- in compliance with the retention periods established by the laws and regulations governing financial and accounting records;
- while DATEKS.LV, its customer or supplier may exercise its legitimate interests in accordance with the procedure established by external laws and regulations (e.g. to submit objections, to bring or pursue legal action, a product warranty is valid, etc.);
- while contractual obligations exist between DATEKS.LV and the Customer.
- For example, the Customer places orders and makes payments through the profile created on the website; the
- video surveillance data is stored for 30 days. In case of suspicion of criminal offences, personal data is necessary to protect the legitimate interests of DATEKS.LV or third parties or a request from law enforcement authorities, the data is stored as necessary.
DATEKS.LV does not transfer personal data to third countries or international organisations
By contacting the controller - DATEKS.LV, using the contact information specified in paragraph 1 of this Privacy Policy, in accordance with the GDPR, the data subject, i.e. the Customer, is entitled to request from DATEKS.LV:
- access to the personal data of the data subject, to provide the personal data of the data subject held by the Data Controller;
- rectification or erasure of the data subject's personal data;
- restrict (suspend for a specified period of time) the processing of certain types or all of the data subject's personal data;
- cease automated processing of personal data concerning the data subject (automated individual decision-making in relation to the Customer). DATEKS.LV does not carry out profiling;
- request the portability of personal data in the cases set out in the GDPR.
Thedata subject, i.e. the Customer, has the following rights in relation to the processing of personal data by DATEKS.LV, if the processing has been carried out on the basis of the data subject's consent:
- If the processing of personal data is based on the data subject's consent, the data subject has the right to choose to what extent and what data to submit to DATEKS.LV, as well as at any time to withdraw consent to the processing of his/her personal data in whole or in part by asking DATEKS.LV to terminate the processing of all or a certain part of the data subject's personal data. The withdrawal of consent shall not affect the lawfulness of the processing of the data subject's personal data carried out prior to the withdrawal;
- Ņemot vērā to, ka DATEKS.LV ir nepieciešams nepārprotami identificēt datu subjektu, kurš pilnībā vai daļēji atsauc piekrišanu personas datu apstrādei, atsaukumu, kurā norādīti datu subjekta identifikācijas dati, t.sk. vārds, uzvārds, datums, kā arī apjoms, kādā datu subjekta piekrišana datu apstrādei tiek atsaukta, datu subjekts var iesniegt kādā no turpmāk minētajiem veidiem: 1) nosūtot pašrocīgi parakstītu atsaukumu uz šīs Privātuma politikas 1.punktā norādīto DATEKS.LV juridisko adresi; 2) nosūtot atsaukumu, kas parakstīts ar klienta drošu elektronisko parakstu, uz šīs Privātuma politikas 1.punktā norādīto DATEKS.LV e-pasta adresi; 3) ierodoties personīgi Privātuma politikas 1.punktā norādītajā DATEKS.LV birojā un uzrādot personu apliecinošu dokumentu; 4) izmantojot komerciālajā paziņojumā vai sīkdatņu paziņojumā norādītās saites.
Thedata subject, i.e. the Client, has the right to obtain from DATEKS.LV information on the fact of transfer of the data subject's personal data to third parties and on the persons (natural or legal) and/or state institutions to which DATEKS.LV has provided any information related to the personal data of a particular data subject (unless such information has been provided on the basis of a request from the subject of operational activity or another competent institution and the law directly prohibits disclosure of the information).
- In case of any questions regarding the processing or protection of personal data by DATEKS.LV, the data subject, i.e. the Customer, shall also have the right to contact DATEKS.LV using the contact details of DATEKS.LV specified in Clause 1 of this Privacy Policy.
- In case of disputes in relation to the processing of personal data by DATEKS.LV, the data subject has the right to lodge a complaint with the supervisory authority - the Data State Inspectorate.
- DATEKS.LV may make changes to this Privacy Policy if the amount, type or circumstances under which the personal data are processed change. In such case, DATEKS.LV will provide data subjects with relevant information. This is the Customer Privacy Policy as of: 08.03.2023.
